Privacy Policy

This Privacy Policy explains how Chayland Design LLC (“Chayland Design,” “we,” “our,” or “us”) collects, uses, shares, and protects personal information when you visit chayland.com and its pages (the “Website”), fill out a form, buy a product or package, attend an event, or otherwise interact with us. By using the Website, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Website.

This policy covers the Website and our marketing, sales, and event activities. It does not cover information we handle for a client under a signed agreement. That work is governed by the agreement and any confidentiality terms in it.

1. Information We Collect

Information you give us

We collect the information you choose to send us, such as when you:

  • Take the AI Readiness Assessment and ask for your full results
  • Subscribe to our newsletter or sign up for a resource
  • Book a call, register for an event, or apply to build live at MVP Build Lab
  • Buy a package, guide, or ticket
  • Email us or send us a message

Depending on the form, this can include your name, email address, phone number, company or agency name, role, your answers to assessment questions, details about your project or idea, and anything else you choose to include. Please do not send us sensitive personal information (such as health, financial account, or government ID information) or confidential business information through the Website. Anything you share before a signed agreement is not treated as confidential unless we have agreed to that in writing.

Information collected automatically

When you visit the Website, our hosting and security providers automatically receive standard technical information, such as your IP address, browser and device type, the pages you request, the referring page, and the date and time of your visit. We use it to deliver the Website, keep it secure, and fix problems. We also use Google Analytics to understand how visitors use the Website, as described in Section 3. We do not use advertising pixels or cross-site advertising tracking.

Information from other sources

When you use a service we link to, such as a scheduling, ticketing, or payment page, that provider may share with us the details you entered there (for example, your name, email, and booking or order details) so we can deliver what you asked for. We never receive your full card number.

2. How We Use Information

We use personal information to:

  • Respond to you and provide what you asked for, including assessment results, guides, bookings, tickets, and packages
  • Run, secure, maintain, and improve the Website, and protect it against spam, fraud, and abuse
  • Send newsletters and updates you signed up for (you can unsubscribe at any time)
  • Plan and deliver our services and events
  • Keep business records, meet legal, tax, and accounting obligations, and enforce our terms
  • Protect the rights, property, and safety of Chayland Design, our clients, and others

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not use your personal information to make decisions that produce legal or similarly significant effects about you.

3. Cookies and Similar Technologies

The Website does not use advertising cookies. We use the following:

  • Analytics. We use Google Analytics to see how many people visit, which pages they view, how they found the Website, and which links they click, such as booking, checkout, and sign-up links. Google Analytics uses cookies and similar technology and receives information such as your device and browser, approximate location, and your activity on the Website. We have turned off Google Signals and advertising personalization, and we use analytics only in aggregate, not to identify you. Google processes this information under its own Privacy Policy. If you visit from the European Union, the European Economic Area, the United Kingdom, or Switzerland, we ask for your consent first, and analytics does not run unless you accept. We use your IP address only at the moment of your visit to tell which region you are in, and we do not store it. Everyone can turn analytics off in Section 7, or install the Google Analytics Opt-out Browser Add-on.
  • Fonts. Our typefaces are served from our own website, so loading them does not send your information to anyone else.
  • Spam protection. The AI Readiness Assessment uses Google reCAPTCHA to tell people from bots. reCAPTCHA collects hardware and software information and sends it to Google. Your use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.
  • Your browser’s storage. Some features remember your choices in your own browser, such as your analytics choice and the MVP Build Lab packing checklist. That information stays on your device and is not sent to us.
  • Third-party pages. Scheduling, ticketing, payment, and newsletter providers may set their own cookies when you use their pages or embedded forms, under their own policies.

You can block or delete cookies in your browser settings. Some features may not work if you do. If your browser sends a Global Privacy Control signal, we turn analytics off automatically. We do not track you across other websites.

4. How We Share Information

We share personal information only as described here:

  • Service providers who help us run the business, under contracts that limit their use of your information. These include website hosting and infrastructure (Vercel and GitHub), email delivery (Resend), newsletters and marketing email (ActiveCampaign), scheduling (Calendly), event registration (Luma), forms (Google Forms), spam protection and analytics (Google), payments (Stripe), and digital product sales (Gumroad).
  • Legal and safety reasons, when we believe in good faith that disclosure is required by law, subpoena, or court order, or is needed to protect the rights, property, or safety of Chayland Design, our clients, users, or the public.
  • Business transfers, if we are involved in a merger, acquisition, financing, or sale of assets, in which case information may transfer to the new owner under this policy.
  • With your consent or at your direction.

Payment and checkout pages are run by Stripe, Gumroad, and Luma under their own privacy policies. We encourage you to read them.

5. How Long We Keep Information

We keep personal information only as long as we need it for the purposes above, such as delivering what you asked for, keeping required business and tax records, resolving disputes, and enforcing our agreements. Newsletter information is kept until you unsubscribe, plus a short period to honor that choice. When we no longer need information, we delete it or make it anonymous.

6. How We Protect Information

We use reasonable administrative, technical, and physical safeguards, including encrypted connections, restricted access, and reputable providers. No website, transmission, or storage system is completely secure, so we cannot guarantee absolute security. You share information at your own risk, and you are responsible for keeping your own devices and accounts secure. If we learn of a security incident that affects your personal information, we will notify you as required by law.

7. Your Choices

  • Emails. Every newsletter includes an unsubscribe link. You can also email us. We may still send messages about a purchase, booking, or engagement.
  • Access, correction, and deletion. You can ask to see, correct, or delete the personal information we hold about you by emailing chay@chayland.com.

8. California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), gives you the rights described below. This section explains our practices over the past 12 months.

  • Categories we collect: identifiers (name, email, phone, IP address); commercial information (purchases, bookings, and tickets); professional information (company, agency, and role); internet activity (technical information about your visit); and the information in your messages and assessment answers. We do not knowingly collect sensitive personal information as defined by the CCPA.
  • Sources: directly from you, automatically from your device, and from the service providers listed above.
  • Purposes: the purposes in Section 2.
  • Disclosures: to the service providers in Section 4, for business purposes. We have not sold or shared personal information as those terms are defined by the CCPA, and we have no actual knowledge of selling or sharing information about anyone under 16.

You have the right to know what personal information we collect, use, and disclose; to access it; to correct it; to delete it; to opt out of its sale or sharing (which we do not do); to limit the use of sensitive personal information (which we do not collect); and to not be discriminated against for using these rights. To make a request, email chay@chayland.com with the subject line “California Privacy Request.” We will confirm receipt within 10 business days and respond within 45 days, and we may need to verify your identity by matching information you provide with information we already have. An authorized agent may make a request for you with your signed permission. We may deny a request as the law allows, and we will tell you why.

California’s “Shine the Light” law (Civil Code Section 1798.83) lets California residents ask whether we disclosed personal information to third parties for their direct marketing. We do not do this.

9. Visitors Outside the United States

We are based in the United States, and the Website is intended for people in the United States. If you visit from elsewhere, your information will be processed in the United States, where privacy laws may differ from those where you live. If the EU or UK General Data Protection Regulation applies to you, we process your information to respond to your requests and provide services (contract), for our legitimate interests in running and securing our business, to meet legal obligations, and with your consent for newsletters and analytics. You can withdraw your consent to analytics at any time in Section 7, and withdrawing it does not affect anything done before. You may have the right to access, correct, delete, restrict, or port your information, to object to processing, to withdraw consent, and to complain to your local data protection authority. 10. Children

The Website is meant for businesses and adults. It is not directed to children under 16, and we do not knowingly collect personal information from anyone under 16. If you believe a child has sent us personal information, email us and we will delete it.

11. Links to Other Websites

The Website links to websites, tools, books, and platforms we do not control, such as Stripe, Gumroad, Calendly, Luma, Amazon, and social media sites. We are not responsible for their content or privacy practices. Their own policies apply when you use them.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the new version on this page and change the “Last updated” date. If we make a material change, we will take reasonable steps to let you know. Your continued use of the Website after an update means you accept the updated policy.
